Market Overview

Malta progressed from decriminalisation in 2015 (≤3.5 g; €50–€100 fines) to full legalisation in December 2021, becoming the first EU member state to legalise adult-use cannabis. The reform followed a 2021 government white paper and public consultations that framed cannabis policy around harm reduction and reducing illicit market reliance.
Operational rollout required new institutions and standards; by January 2024 the first Cannabis Harm Reduction Association (CHRA) began sales. As of April 2025, 19 CHRAs hold operating permits issued by the Authority for the Responsible Use of Cannabis (ARUC).

Personal Consumption Regulations

  • Possession: Adults (18+) may possess up to 7 g. Possession >7 g to 28 g is an infringement handled by the Commissioner for Justice; higher amounts may lead to criminal liability.
  • Record relief: Individuals with legacy offences now decriminalised/legal may apply to deregister convictions.
  • Use locations: Private consumption only; public use and consumption in the presence of a minor are prohibited and subject to penalties.
  • Home cultivation: Up to 4 plants per residence; ≤50 g dried cannabis may be stored at home. Plants must not be visible from public spaces.

CHRA (Association) Regulations

  • Licensing & oversight: CHRAs must be registered and licensed by ARUC; subject to strict compliance, monitoring, and annual financial reporting.
  • Non-profit & siting: Must operate on a non-profit basis; located ≥250 m from schools, clubs, and youth centres.
  • Membership: Residents, 18+ only; max 500 members per CHRA; no advertising or promotion permitted.
  • Products & packaging: Flowers only; tamper-evident, child-resistant packaging with labelling and health warnings. On-site consumption of cannabis or alcohol is prohibited.
  • Dispensing limits: Max 7 g/day and 50 g/month per member; members under 21 restricted to products <18% THC.
  • Distribution sites: Sales only at permitted distribution premises.
  • Annual licence fees (by membership size):
    • 0–50: €1,000
    • 51–100: €5,000
    • 101–250: €13,000
    • 251–350: €18,000
    • 351–500: €26,000

Cannabis Cultivation Associations & Market Activation

  • First sales: January 2024—KDD Society (KDD) completed Malta’s first legal adult-use sales; reached 250 members within a week, signalling strong consumer demand.
  • Scale-up: By April 2025, 19 CHRAs are operating, reflecting progressive licensing despite early ministerial changes and regulatory refinements that delayed the initial launch.

Market Outlook

Malta’s non-profit association model prioritises harm reduction, traceability, and youth protection while eschewing commercial retail. Near-term developments hinge on ARUC’s supervisory capacity, product quality assurance, and member-education standards. Over time, performance data from CHRAs—on illicit-market displacement, public health outcomes, and youth safeguards—will determine whether Malta adjusts THC limits, product scope, or membership caps to optimise policy goals.
